All items shown on this site are for general guidance only.

Flowers:
Due to seasonal and local availability we cannot guarantee that the content of your delivery will always match identically what is shown on this site. In the interest of providing you with the best possible floral delivery our florist may substitute one or more items. If there are particular flowers or colours that you would prefer to be included, or even excluded, then we will do our utmost to meet your request.

Prices:
All prices quoted are in UK pounds sterling and include delivery (as described below).

Delivery:
Orders to be received by 11am for same day delivery. If ordering flowers for weekend delivery, please ensure the order is placed before noon on the Friday. To be sure of 1st choice of flowers and preferred delivery date allow at least 2 working days notice; but can only be accepted up to 14 days in advance. Please ensure the correct address details are provided for the intended recipient and contact details in the event of any delivery problems. We cannot be held responsible for orders being delayed by incomplete or incorrect information.

Should the recipient not be at home we will attempt to deliver to a neighbour or post a card through the letter box informing them that a delivery has been attempted. Please ensure that the correct address is provided for the recipient. If an attempted delivery fails (such as the wrong address specified on the order), we reserve the righ to charge additional costs to re-deliver or to deduct the delivery costs/Product wastage from any refund if the order is subsequently cancelled.

There may be delays in delivery where a third party is involved, such as delivery to hotels and offices. In case of delivery to such locations, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery. Our liability for non-delivery of the products shall be limited to replacing the product within reasonable time.

Alterations / Cancellations:
Alterations to or Cancellation of your order must be notified immediately by calling us on 01904 471996 during office hours and before 9.30am on the day of delivery to ensure that your order has not already been processed and delivered.

Floral Art reserves the right to cancel any order due to any events that are beyond our reasonable control.

Orders:
Please contact us by telephone on 01904 471996 to place an order. By doing this you are consenting to be bound by these Terms and Conditions and those appearing anywhere on the website and authorises us to take payment for the item(s) ordered.

Full payment for all items purchased is required before your order can be despatched. We reserve the right not to process an order if it is believed that the credit transaction may have been made fraudulently. Under such circumstances the customer will be contacted to obtain further information.

Orders cannot be accepted from customers under the age of 18 years.

Complaints:
We are fully committed to providing you with the best possible gift delivery service and we will investigate your complaint and endeavour to respond within five working days at non-seasonal times. (Christmas, Valentines Day and Mothers Day may take longer). We will keep you informed throughout the complete process and if we are satisfied that your complaint is genuine a replacement or refund will be given. This does not affect your statutory rights as a customer. FLOWERS/PLANTS. If you are dissatisfied with the service you have received please notify us within 24 hours of delivery and retain the item concerned. Complaints on quality cannot be investigated if made later than 7 days following date of delivery. All these items are perishable in nature and so cannot be returned under the distance selling regulations.

Limitation Of Liability:
In no event will floral Art be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or other tortuous action, arising out of or in connection with the use of the site.

Disclaimer:
Floral Art does not warrant that the functions contained in the website will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. The site and the information, names, images, pictures, logos and icons regarding or relating to Floral Art and its products and services (or to third party products and services), is provided “as is” and on an “is available” basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

Privacy Policy:
We are committed to protecting your privacy (in accordance with the Data Protection Act 1998). We shall only use the information received from you for the purpose of processing your order and to provide you with the best possible service. We will never share your confidential information with anyone, and will not e-mail you in the future unless you have given us your consent.

General:
Floral Art reserves the right to supplement and amend the Terms and Conditions. It is the responsibility of the customer to review the Terms and Conditions when using the website. They shall be governed by English law and the parties hereby agree to submit themselves to the exclusive jurisdiction of the English Courts. These terms and conditions do not affect your statutory rights.
